By accessing or using TheBatchly's website, school management system, ERP or mobile apps (the "Services"), you agree to be bound by these Terms & Conditions. If you are using the Services on behalf of a school, you confirm you are authorised to bind that institution.
TheBatchly provides a cloud-based, AI-powered platform for managing admissions, attendance, fees, examinations, transport, communication and related school operations, along with connected Parent, Student, Teacher and Driver mobile apps.
Schools are responsible for maintaining the confidentiality of account credentials, for all activity under their accounts, and for the accuracy and lawfulness of data they upload. You agree to use the Services only for lawful, educational and administrative purposes.
Access to the Services is provided on a subscription basis as set out in your quote or order. Fees are typically charged per student per year for the modules selected. Unless otherwise agreed, fees are payable in advance and are non-refundable except as required by law.
Where included in your plan, we provide onboarding, configuration, data migration and training. You agree to provide accurate source data and reasonable cooperation to enable a smooth go-live.
You agree not to misuse the Services, including by attempting unauthorised access, disrupting the platform, reverse-engineering it, or uploading unlawful, infringing or harmful content.
TheBatchly and its licensors own all rights in the platform, software, design and content. You receive a limited, non-exclusive, non-transferable right to use the Services for the duration of your subscription. Data you upload remains yours.
Our handling of personal data is described in our Privacy Policy, which forms part of these terms. The school acts as data controller for student, parent and staff records; TheBatchly acts as processor.
We strive for high availability and perform maintenance with reasonable notice where practical. The Services are provided on a commercially reasonable-efforts basis and may occasionally be unavailable due to maintenance or factors beyond our control.
To the maximum extent permitted by law, TheBatchly is not liable for indirect, incidental or consequential losses. Our total liability is limited to the fees paid by the school in the twelve months preceding the claim.
Either party may terminate in accordance with the subscription agreement. On termination, your access ends and we will delete or return your data as described in the Privacy Policy and your agreement.
We may update these terms from time to time. Material changes will be communicated to schools, and continued use of the Services after changes take effect constitutes acceptance.
These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the competent courts in India, unless otherwise agreed in writing.
